Welcome to AceMyStates ("Platform", "Service", "we", "us", "our"). By creating an account or using our Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
1. Eligibility and COPPA Compliance
AceMyStates is designed for students in grades 3 through 12. Users under the age of 13 must have verifiable parental or guardian consent before creating an account. We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 without parental consent. If you are a parent or guardian and believe your child has provided personal information without your consent, contact us immediately at acemystates@gmail.com.
2. Account Registration
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. Each account is for a single individual. Sharing accounts is prohibited. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Description of Service
AceMyStates provides AI-powered test preparation tools for the NYC Specialized High Schools Admissions Test (SHSAT) and New York State standardized tests (grades 3-8). The Service includes adaptive practice questions, essay grading, flashcards, reading passages, exam simulations, progress tracking, and a weekly competitive leaderboard. AI-generated content is for educational purposes and may not be error-free. We do not guarantee any specific test score improvements.
4. Subscription Plans and Payments
AceMyStates offers free (Starter), paid monthly, and paid annual subscription tiers (Core and Max). Paid subscriptions are billed through Stripe. By subscribing, you authorize recurring charges to your payment method at the frequency you selected. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis at our discretion. Prices are subject to change with 30 days notice.
5. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service or its related systems; (c) reverse-engineer, decompile, or disassemble any part of the Service; (d) use automated scripts, bots, or scrapers to access the Service; (e) share, resell, or redistribute content generated by the Service for commercial purposes; (f) submit false, misleading, or offensive content; (g) harass, bully, or harm other users; (h) manipulate the leaderboard, coins, or ranking system through fraudulent activity; (i) create multiple accounts to circumvent usage limits or gain unfair advantages.
6. Intellectual Property
All content, code, design, text, graphics, logos, and other materials on AceMyStates are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.
7. Privacy and Data Collection
We collect and process personal data as described in our Privacy Policy. This includes: name, email address, parent or guardian email (if provided), grade level, test scores and practice history, subscription and payment information (processed by Stripe; we do not store full card numbers), device and usage information for analytics and Service improvement. We do not sell personal information to third parties. Data is stored securely using Supabase infrastructure with row-level security policies and encrypted connections.
8. AI-Generated Content Disclaimer
The Service uses artificial intelligence to generate practice questions, grade essays, and provide feedback. AI-generated content may contain inaccuracies. The Service is a supplementary educational tool and should not be relied upon as the sole source of test preparation. We are not responsible for decisions made based on AI-generated content.
9. Third-Party Services
AceMyStates integrates with third-party services including Stripe (payments), Supabase (database and authentication), DeepSeek (AI content generation), and Resend (email delivery). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
10. Limitation of Liability
To the maximum extent permitted by law, AceMyStates and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or interruption of service. Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless AceMyStates, its operators, affiliates, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.
12. Termination
We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will survive.
13. Modifications to Terms
We may update these Terms from time to time. We will notify users of material changes via email or a notice on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.
